We are seeking an experienced, proactive and tech-savvy attorney to join our legal team. This position will involve managing a high volume and wide range of simple and complex contracts related to the organization’s marketing and technology efforts. Additionally, the role will encompass developing and managing LPGA’s privacy program.

ESSENTIAL DUTIES AND RESPONSIBILITIES
  • Marketing. Partnering with the marketing team to develop and maintain an international marketing compliance program, including implementing internal marketing standards. Reviewing and analyzing marketing and advertising materials across all communication channels to ensure compliance with legal and internal standards. Providing advice on privacy and data security compliance, policies, and processes in advertising, advertising sales, advertising measurement and research, content distribution, and data sharing initiatives across affiliates and third parties.
  • Media & Content. Assessing and providing strategic legal solutions for intellectual property rights clearance (music, talent, film), rights of publicity, trademark, copyright, and user-generated content to ensure compliance with laws and regulations. Creating, reviewing, and negotiating agreements with influencers and content creators, music licensing, on-air talent agreements, and related service contracts. When required, negotiating, drafting, and reviewing media, broadcast, and content license agreements, including distribution agreements (online & TV), telecast/radio broadcast rights agreements, production services agreements, and domestic/international content licensing agreements.
  • Technology. Negotiating, drafting, and interpreting technology agreements such as cloud-based platforms, SaaS agreements, and contracts for website/mobile app development. Conducting technology due diligence reviews for all new and renewing technology services to ensure compliance with legal and internal standards. Providing legal support for digital technologies, including digital commerce, social media, and advertising sales integrations such as programmatic and addressable ad sales.
  • Privacy & Data Governance. Designing, implementing, and managing a comprehensive privacy and data governance program covering data mapping, classification, handling, data subject requests, security incident response, and vendor due diligence. Drafting external privacy policies, disclosures, disclaimers, and legal notices for the organization’s digital platforms and public touchpoints (landing pages, collection points, cookies, collateral). Managing data retention and data management policies to promote data privacy and records management best practices across the organization.

QUALIFICATIONS
  •  J.D. degree from an accredited law school
  • Licensed to practice law in the United States and in good standing (if not licensed in Florida, then ability to qualify for Authorized House Counsel status)
  • Minimum of 7 years of experience supporting global marketing teams, including reviewing advertising and promotional materials, drafting disclosures, and clearing intellectual property rights.
  • Minimum of 5 years of experience in negotiating and structuring technology contracts, including SAAS, ad tech and commercial agreements.
  • Strong knowledge of state, federal, and global data privacy laws (GDPR, LGPD, CCPA, CPRA, VCDPA, CPA), consumer protection laws (FTC, FCC, CAN-SPAM, COPPA, TCPA), marketing and advertising guidelines (DAA, NAI), and cybersecurity regulations (SEC).
  • Advanced proficiency in Microsoft Office suite, including SharePoint administration, OneDrive, Office 365 Word, and electronic signature applications.
  • IAPP CIPP/US and CIPP/EU Certification preferred
  • Experience and/or certifications with Microsoft Office, OneTrust and Formstack preferred. 
  • Experience providing legal support for television and digital media, including DTC services, linear television channels, and FAST channels on various platforms preferred.
